Workers' compensation insurance is written to conform and comply with the workers' compensation laws of the state in which it's written. Most states mandate that any person or entity that employs at least one person must secure this coverage.

Employer's liability is automatically included as part of workers' compensation insurance and responds to any common law liability that may be imposed upon an employer outside the provisions of a workers' compensation law.
